Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Blightfell (the “Service”), provided by Merlyn Labs (“Merlyn Labs,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Overview

Blightfell is a web-based experience with optional blockchain features operating primarily on the Abstract and Arbitrum networks. Certain in-game assets may be represented as on-chain items. The in-game soft currency, called Favor, is an in-experience balance and is not a digital asset or currency on its own.

2. Eligibility and Accounts

You must be legally capable of forming a binding contract in your jurisdiction to use the Service. If you connect a wallet, you are responsible for safeguarding its credentials and for activities conducted via that wallet. We do not control your wallet or private keys.

3. On-Chain Interactions and Abstract/Arbitrum Networks

Interactions with the Abstract and Arbitrum networks may be irreversible and may incur network fees. You acknowledge that transactions on Abstract and Arbitrum are public and immutable. We do not control the networks and are not responsible for network outages, congestion, forks, or other protocol-level events.

4. Favor (In-Experience Balance)

Favor is a gameplay balance that may be earned or spent within Blightfell. Favor is not legal tender, not a financial instrument, and has no intrinsic monetary value outside the experience. We may modify accrual or redemption rules, or reset balances in connection with gameplay updates, balancing, or enforcement.

5. Ownership; License to Use the Service

The Service, including all content and materials provided by Merlyn Labs, is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

6. Prohibited Conduct

You agree not to: (a) attempt to breach or circumvent security; (b) use bots, exploits, or unauthorized automation; (c) interfere with other users’ enjoyment; (d) infringe any third-party rights; or (e) use the Service in violation of applicable laws.

7. Feedback

If you provide feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free license to use and incorporate it without compensation or obligation.

8. Third-Party Services

The Service may rely on or link to third-party services (e.g., wallet providers or infrastructure). We do not control third parties and are not responsible for their content or services. Your use of third-party services is subject to their terms and policies.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERLYN LABS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

11. Changes to the Service and Terms

We may update the Service and these Terms from time to time. If we make material changes, we will provide notice by updating the “Effective date” above or through the Service. Your continued use of the Service after changes become effective constitutes acceptance.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we believe you violated these Terms. Upon termination, provisions that by their nature should survive will survive, including ownership, disclaimers, and limitations of liability.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Santa Clara County, California, for all disputes arising out of or relating to the Service or these Terms.
